Adult waiver

I hereby give my consent to my participation in any golf program or facility usage (the "class program, individual lesson and/or indoor facility usage") presented by Thompson Golf, Inc. d/b/a Thompson Golf Academy d/b/a Magic City Indoor Golf. On behalf of myself, I the undersigned, hereby release Thompson Golf Inc. (“Thompson Golf Academy” and/or “Magic City Indoor Golf”) and its shareholders, directors, officers, employees, agents, and contractors, from all liability in connection with my participation in any class program, individual lesson and/or indoor facility usage. I acknowledge that the activities conducted during any lesson/program may present a risk of injury/illness to me, including but not limited to, exposure and possible contraction of COVID-19 or a variant thereof, and I voluntarily assume such risk of injury/illness. I further agree to indemnify and hold harmless Thompson Golf, Inc. (“Thompson Golf Academy” and/or “Magic City Indoor Golf”) and its shareholders, directors, officers, employees, agents, and contractors, including without limitation Neil Thompson and all other employees, from liability for the injury or other consequences of any injury to any person and damage to any property that may result from my negligence or misconduct while participating in any offerings.

SAFETY & RESPONSIBILITY. Members and all guests of Thompson Golf, Inc. must adhere to all safety rules listed below. Thompson Golf, Inc. reserves the right to remove from the venue any Member or Guest who violates the safety rules. If injury should result because safety rules are not followed or are ignored, I the undersigned acknowledge and agree that Thompson Golf, Inc. will not be liable.

Safety Rules at Magic City Indoor Golf:

1. All players must hit from the mat at all times. No running starts or horseplay.
2. Only the person hitting a ball should stand beyond the island top. All other players should always stand at or behind the island top. Players are responsible for the safety of others around them and should always check their surroundings before swinging a club.
3. Throwing golf balls is prohibited.
4. Thompson Golf, Inc. is not responsible for lost or stolen items.

I hereby give my consent to the possible usage of my image, via social media or in promotion of any golf participation, of my likeness (“Likeness”) in a photograph, video or other digital media taken while participating in the Magic City Indoor Golf presented by Thompson Golf (Academy), Inc. (the “class program, individual lesson and/or indoor facility usage "). I hereby further authorize Thompson Golf Inc. (“Thompson Golf Academy” and/or “Magic City Indoor Golf”) to take and use pictures of me taken my Likeness in a photograph, digital image, video, audio clip and/or testimonial (written words). The images (“Media”) such Likeness may be used and published for marketing and other purposes for the benefit of Thompson Golf Academy (“Magic City Indoor Golf”) including, but not limited to, possible publication in newspapers, social media and, the Thompson Golf Inc., Thompson Golf Academy, and/or Magic City Indoor Golf website and various websites covering our teaching locations websites. I acknowledge Thompson Golf’s (“Thompson Golf Academy” and/or “Magic City Indoor Golf”) right to crop, edit or treat the photograph, video, audio clip or testimonial likeness at its sole discretion. Photos and other images; provided, however Thompson Golf Inc. (“Thompson Golf Academy” and/or “Magic City Indoor Golf”) shall not divulge any names without written permission. Photographs and other media of persons learning and enjoying the game of golf is one of the best methods to encourage others to learn and enjoy the game. We are grateful for your agreement for Thompson Golf inc. (“Thompson Golf Academy” and/or “Magic City Indoor Golf”) to use your Likeness.

I understand that once Media is published in social media and/or a website, such Media can be downloaded by any computer user. The undersigned hereby releases Thompson Golf Inc. (“Thompson Golf Academy” and/or “Magic City Indoor Golf”), its shareholders, directors, officers, employees, agents and contractors, including, without limitation, Neil Thompson and all other employees, as well as any and all users and exhibitors of said Media, from any and all claims, demands, accountings, and causes for which the aforesaid Media may be used pursuant to this consent, waiver and general release. It is also my understanding that I will receive no compensation for the use of my Likeness in Media.
